Terms and Conditions – Online Ordering

The Burrito Bar – Modern Mexican hereby provides its permissions for you to access the website and use ‘Online Ordering’ in escrow to the following Terms and Conditions:

 

ONLINE ORDERING VIA THE WEBSITE

  1. The use of the website is solely intended for individual, personal and non-commercial use and not to intended for resale;
  2. The Burrito Bar – Modern Mexican merely acts as an agent of sub-franchisee stores (except when ordering from corporate stores) from which the product or service will be provided to you (as selected by you or based on your proximity to the nearest restaurant);
  3. The Burrito Bar – Modern Mexican, as an agent, collects and processes any online payment and remits this amount to the store from which the products or services are provided;
  4. The Burrito Bar – Modern Mexican, will not claim any warranties and or representations outside of the restaurant or beyond the intended pick up window
  5. The Burrito Bar – Modern Mexican, does not guarantee the website’s ‘Online Ordering’ system is free error or that any error will be corrected.
  6. Reserves the right to alter the agreed price if an incorrect price was caused by a software fault, error or malicious attack on the website.

 

Refund Policies – Online Ordering

The Burrito Bar – Modern Mexican are happy to offer refunds to customers based on the following circumstances:

  1. Unsuccessful Bank Transactions: In the event of an unsuccessful transaction, for reasons that make the transaction unviable to the The Burrito Bar – Modern Mexican, the purchaser will be obliged to incur a refund automatically via their nominated bank within 5 business days, from the date of transaction.
  2. Refund Policy: If the event of changes to the circumstances of an online order (e.g.: placed in a different store or cancellation of an order) after being placed successfully with payment processed. The purchaser must call store the designated store to cancel purchase (provided the order has not yet been initiated). At the authorisation of the sub-franchisee, the transaction can be refunded in-store only.
